- Be Kind & Respectful: No harassment, spam, hate speech, or illegal content.
- Your Content: You own what you post. You grant us the necessary technical permissions to display it to the community.
- Safety: You must be at least 18 years old to join. SociablePlace does not permit sexually explicit or adult content of any kind, from any user.
Welcome to SociablePlace (“Service,” “the Website,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our platform.
1. Acceptance of Terms
By creating an account, accessing, or using SociablePlace, you agree to be bound by these Terms. If you do not agree to all of these terms, you may not use the Service.
2. Eligibility
You must be at least 18 years old to use the Service. SociablePlace is an adult platform and is not directed at, marketed to, or intended for use by anyone under 18, including teenagers. By using SociablePlace, you represent and warrant that you meet this requirement and that the date of birth you provide at registration is accurate.
If we determine that a user under 18 has created an account, we will immediately suspend the account and delete the associated personal data. See our Privacy Policy, Section 9 (“Children’s Privacy & Minimum Age”), for details on how we work to prevent underage registration in the first place.
3. Account Registration & Security
- Accurate Information: You agree to provide accurate, current, and complete information during registration, including your true date of birth. Falsifying your date of birth to gain access to the Service while under 18 is a violation of these Terms and grounds for immediate account termination.
- Credential Security: You are responsible for maintaining the confidentiality and security of your account login credentials.
- Account Activity: You are fully responsible for all activities and communications that occur under your account.
4. Platform Features & Use of the Service
SociablePlace is a social media platform that allows users to post text, images, and videos; like, comment, and share content; send private messages; and create or participate in groups. You agree to use the Service lawfully, respectfully, and in accordance with these Terms.
5. User Content & Licensing
Your Ownership: You retain ownership of all intellectual property rights in the photos, text, media, or other content you create and share on SociablePlace.
Our License: To operate the platform effectively (e.g., displaying your posts on activity feeds), you grant SociablePlace a worldwide, non-exclusive, royalty-free, transferable license to host, use, display, reproduce, distribute, modify, and create derivative works of your content, solely for the purpose of operating, promoting, and improving the Service.
License Duration: This license ends when your content is deleted, except where it has been shared with others who have not deleted it, or where retention is required for legal reasons.
6. Community Guidelines & Acceptable Use
To keep SociablePlace a safe environment, you agree not to post prohibited content or engage in prohibited conduct.
A. Prohibited Content & Behavior (Strictly Not Allowed)
- Harm & Exploitation: Coordinating harm, promoting crime, human exploitation, or the abuse or nudity of minors.
- Violence & Hate: Threats, bullying, harassment, hate speech, incitement of violence, or graphic violence.
- Fraud & Scams: Engaging in deceptive practices, pyramid schemes, or unauthorized advertising (“spamming”).
- Self-Harm: Promoting or encouraging suicide, self-injury, or eating disorders.
- Dangerous Content: Distributing malware, viruses, or executing cybersecurity threats designed to disrupt site functionality.
- Inauthentic Behavior: Creating fake accounts, engaging in platform manipulation, impersonating site administrators/others, or scraping/collecting user data without explicit permission.
- Infringement: Violating third-party intellectual property or privacy rights.
- Illegal Activity: Promoting or transacting illegal content, products, restricted goods, or services.
- Adult & Sexual Content: SociablePlace does not permit sexually explicit content, non-exploitative adult nudity, pornography, or sexually suggestive material of any kind, regardless of the age of the user posting or viewing it. This is a strict, platform-wide prohibition — there is no adult-only section, filter, or exception. Accounts posting this content are subject to immediate removal under Section 7.
B. Content Requiring Context or Warning Screens
Certain sensitive (non-sexual) content may be restricted or placed behind warning screens rather than removed entirely, depending on whether it provides educational value, news reporting, or awareness (e.g., non-promotional discussions of self-harm or sensitive social/political events). Misinformation may also be labeled or limited.
7. Content Moderation & Enforcement
- Right to Moderate: We reserve the right, at our sole discretion, to review, remove, restrict, or disable access to content or accounts that violate these Terms or are deemed harmful to the community.
- Enforcement Methods: Decisions are made case-by-case using a combination of automated systems and human review. We do not guarantee that all violating content will be detected or removed.
- Monitoring: We may monitor public interactions, private messaging, and groups for safety, legal compliance, and enforcement purposes.
- Reports and Appeals: Users may report content or accounts they believe violate these Terms. If your account or content is impacted by an enforcement action, you may request a review, though final decisions rest with us.
- Mandatory Legal Reporting: Content involving the sexual exploitation, abuse, or endangerment of minors will be removed immediately and reported to the National Center for Missing & Exploited Children (NCMEC) via the CyberTipline, and to law enforcement, as required by federal law (18 U.S.C. § 2258A).
- Non-Consensual Intimate Imagery (NCII): In compliance with the federal TAKE IT DOWN Act, we will remove any validly reported non-consensual intimate imagery within 48 hours of receiving a qualifying report. See our [NCII Reporting Process] for how to submit a report.
8. Advertising, Analytics, & Third-Party Links
We may display advertisements and use analytics tools to improve the platform, which may target ads based on your activity and preferences, consistent with our Privacy Policy. SociablePlace may contain links to external third-party websites; we do not endorse or assume responsibility for any third-party sites, products, or services.
9. Termination
We reserve the right to suspend or terminate your access to the Service at any time, without prior notice or liability, if you violate these Terms, create legal exposure, or cause risk to our community.
Upon termination, your public content will generally be removed from the platform within 30 days, subject to our data retention obligations described in the Privacy Policy.
10. Disclaimers & Limitation of Liability
- “As Is” Basis: SociablePlace is provided on an “as is” and “as available” basis. We do not guarantee that the platform will be uninterrupted, secure, or error-free.
- Limitation of Liability: To the fullest extent permitted by law, SociablePlace shall not be liable for user-generated content, user interactions, loss of data, or any indirect, incidental, or consequential damages resulting from your use of the platform.
11. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles, and applicable United States federal law. Any disputes shall be resolved in the state or federal courts located in Broward County, Florida, and you consent to personal jurisdiction there.
12. Changes to Terms
We may update these Terms from time to time. We will notify users of significant changes via the platform activity feed or email. Your continued use of SociablePlace after changes are posted constitutes your acceptance of the new terms.
